“Gather ye rosebuds while ye may,” Robert Herrick wrote in his famous poem, urging people to act without delay. That same advice can apply to a person’s or a company’s decision on whether to seek justice through a court of law. If a person delays too long, a statute of limitations may prohibit a lawsuit from ever being filed.
For example, in Arizona, a lawsuit claim based on the breach of an oral contract is subject to a three-year statute of limitations. Other claims may be subject to different limitations, some much shorter. A person with a claim against a public entity, such as a city or state, for example, must serve a notice of claim within 180 days or may not be permitted to bring a lawsuit at all.
